Manos Limpias Lawyer Resigns Over “Political” Case Against Begoña Gómez
Lawyer Withdraws From Case Against Spanish Official, Alleging Politicization
A lawyer representing the Manos Limpias association has resigned from a case targeting Begoña Gómez, the wife of Spanish Prime Minister Pedro Sánchez, citing concerns that the legal proceedings have been overtaken by political and media maneuvering. Carlos Perales, the attorney, stated the case has drifted from a pursuit of legal truth to a platform for political controversy.
The case initially centered on allegations regarding contracts awarded to a company while Gómez held a position at a university. However, Perales’ resignation letter, details of which have emerged, reveals a growing discomfort with the direction of the legal strategy.
“What began as a strictly technical legal assignment, aimed at a fair judicial resolution based on facts and the right to effective legal protection, has gradually transformed into something that exceeds the legal framework,” Perales wrote. He argued that decisions regarding the litigation were increasingly driven by “political opportunity, public opinion impact, or ideological positioning” rather than sound legal principles.
While acknowledging the association’s right to pursue a public or media-focused strategy, Perales emphasized that such an approach is “incompatible with the practice of law, which is based on independence, technical rigor, and strict adherence to objective legal criteria.”
He further pointed to the Spanish Code of Ethics for Lawyers, which mandates independence and protection of the legal profession from external pressures. Perales warned that using legal proceedings as a tool for political ends compromises this independence and erodes public trust in the legal system.
“Lawyers must act as legal operators, not as political agents or media spokespersons,” he stated. “Maintaining legal representation in a scenario where timing and messaging are designed more for public impact than procedural effectiveness would violate the professional mandate assumed and blur the essential boundary between the technical defense of the law and the political instrumentalization of the process.”
The resignation raises broader questions about the intersection of law and politics, particularly in high-profile cases that attract significant public attention. Legal experts note that while advocacy is a core function of the legal profession, maintaining a clear separation between legal strategy and political objectives is crucial for upholding the integrity of the justice system.
According to a 2023 report by the American Bar Association, maintaining public trust in the legal system is paramount, and perceived politicization of legal proceedings can significantly damage that trust. The report highlighted the importance of ethical conduct and independence for lawyers to ensure fair and impartial justice.
This case underscores the challenges faced by lawyers navigating politically charged environments and the importance of upholding professional ethics in the face of external pressures. The outcome of the case remains to be seen, but Perales’ departure serves as a stark reminder of the potential for political interference to undermine the legal process.
